Defense model for accused persons detained in police units in Chile

The obligation to guarantee access to defense from the first hours of detention derives from international treaties to which the Chilean State is a party and from national regulations. However, there are still difficulties in its compliance. In order to reduce the gaps, technical assistance was provided from the European Union EUROsociAL + Program to the Chilean Public Defender’s Office. Technical assistance produced this document. It contains the proposal for the implementation of a Defense Model in police units based on shifts, so that every day of the year, 24 hours a day, there are a sufficient number of defenders available to cover the police stations and interview detainees, in the first hours of the deprivation of liberty. This requires the establishment of a direct communication system between the police, PDI and the defenders on duty, to assist each detained person.
